General Provisions:

These conditions are exclusively valid between the company Barro’s Bike Factory srl, with registered office in Via Primo Maggio 6/8 Gorlago (BG) and any consumer (i.e. the natural person who, having purchased a product, acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out) who makes online purchases on the website www.barrosbike.it, hereinafter referred to as ''CUSTOMER''. Our offer is aimed at end consumers, the sale of goods is only in domestic quantities. These conditions may be subject to change and the date of their publication on the website is equivalent to their effective date.

The sales contract is considered concluded with the sending by Barro’s Bike Factory srl to the CUSTOMER of an order confirmation email. The email contains the CUSTOMER's data and the order number, the price of the purchased goods, shipping costs and the delivery address to which the goods will be sent and the link to view and save these conditions.

The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly communicate any corrections to Barro’s Bike Factory srl.

Barro’s Bike Factory srl undertakes to describe and present the items sold on the website in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the website and the actual product may appear. Furthermore, the photographs of the products presented on www.barrosbike.it do not constitute a contractual element, as they are only representative. Only the description of the item is binding.

Barro’s Bike Factory srl undertakes to deliver the goods within the times communicated on the website, starting from the sending of the order confirmation to the CUSTOMER.

Product availability refers to the actual availability at the time the CUSTOMER places the order. This availability must in any case be considered purely indicative because, due to the simultaneous presence of multiple users on the website, products could be sold to other CUSTOMERS before order confirmation.

Even after the order confirmation email sent by Barro’s Bike Factory srl, cases of partial or total unavailability of goods may occur. In this eventuality, the order will be automatically adjusted with the elimination of the unavailable product and the CUSTOMER will be immediately informed via email.

If the CUSTOMER requests the total or partial cancellation of the order, Barro’s Bike Factory srl will refund the total or partial amount paid within 7 days from the day Barro’s Bike Factory srl became aware of this decision by the customer via email.

Payment by the CUSTOMER can be made by bank transfer or credit card.

Payment by Credit Card takes place via the websites of credit card companies. Financial data is never communicated to Barro’s Bike Factory srl nor stored by Barro’s Bike Factory srl.

All sales prices of the products indicated on the website www.barrosbike.it are expressed in Euros and include VAT applicable in the country of destination within the European Community. If a country outside the European Community is selected, prices are net of VAT. The correct and binding VAT for the purpose of the order is calculated during the ordering process when the customer enters the destination address of the goods.

Shipping costs are not included in the purchase price, but are indicated and calculated at the time of completion of the purchase process before payment is made. See also on our website under shipping and payment.

The CUSTOMER accepts the right of Barro’s Bike Factory srl to change its prices at any time, however the goods will be invoiced based on the prices indicated on the website at the time the order was created and indicated in the confirmation email sent by Barro’s Bike Factory srl to the CUSTOMER.

In case of a computer, manual, technical, or any other error that may lead to a substantial change, not foreseen by Barro’s Bike Factory srl, in the public sales price, making it exorbitant or clearly negligible, the purchase order will be considered invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 7 days from the date of cancellation.

In accordance with current legal provisions, consumers (any natural person who enters into a legal transaction for purposes predominantly not attributable to their commercial or independent professional activity, §13 German Civil Code) have the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days, starting from the date of receipt of the goods. The direct costs of returning the goods will be borne by the customer.

The CUSTOMER may exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract, by filling out the return form in our returns portal, or by sending the withdrawal form, the text of which is reported below and which will also be sent by us in PDF format together with the terms and conditions of sale along with the order confirmation:

In case of exercise of the right of withdrawal, the customer is required to return the goods within 14 days from the day on which they communicated to Barro’s Bike Factory srl their intention to withdraw from the contract.

The right of withdrawal referred to in articles 52 to 58 of Legislative Decree 6 September 2005, n. 206 (Consumer Code) for distance contracts and contracts negotiated off-premises is excluded in relation to the supply of custom-made or clearly personalised goods. All video and audio products and software (e.g. CDs, DVDs, floppy disks, memory cards) are also excluded from the right of return, if the customer has opened the packaging/seal.

In addition to the statutory right of withdrawal mentioned above, Barro’s Bike Factory srl voluntarily grants an extended right to return goods for 30 days from the date of delivery of the goods (the delivery date shown on the carrier's tracking is binding). The goods must be returned to us within 30 days. A condition for exercising this right is that the goods are new, complete with everything that was in the packaging, in their undamaged original packaging and packed in suitable transport packaging. If these conditions are not met, Barro’s Bike Factory srl may refuse acceptance or demand compensation for the loss of value of the goods. This extended right of return does not apply to gift vouchers, food or items that have been individualised according to the customer's requests. The statutory right of withdrawal remains unchanged and valid in all its aspects. Barro’s Bike Factory srl reserves the right to cancel the voluntary extended right of return from the general terms and conditions of sale at its discretion.

In case of receipt of non-conforming or defective products, the legal guarantee of conformity applies according to current law and for a duration of 2 years.

All products presented on the website www.barrosbike.it benefit, in addition to the legal guarantee of conformity referred to in the previous article, from a commercial guarantee offered by the manufacturer, the duration of which is stated on the product sheets of the items and which has no effect whatsoever on the 2-year legal guarantee of conformity

To avail of warranty assistance, the CUSTOMER must keep the purchase receipt sent to the customer upon shipment of the product

Products will be delivered by courier to the address indicated by the CUSTOMER at the time of the order

For every order placed on the website www.barrosbike.it, Barro’s Bike Factory srl issues a receipt for the goods shipped. After the receipt is issued, it will not be possible to make any changes to the data indicated therein.

Barro’s Bike Factory srl assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if caused by malfunctions and disservices of the internet network, in the event that it is unable to execute the order within the times provided for by the contract.

The CUSTOMER has the right to access the website for consultation and to make purchases. No other use, in particular commercial, of the website or its content is permitted. The integrity of the elements of this website, whether sound or visual, and the related technology used remain the property of Barro’s Bike Factory srl and are protected by intellectual property rights.

The website www.barrosbike.it uses "cookies". Cookies are electronic files that record information relating to the CUSTOMER's navigation on the site (pages visited, date and time of the visit, etc.) and that allow Barro's Bike Factory srl to offer a personalized service to its customers.

Barro's Bike Factory srl informs the Customer of the possibility to deactivate the creation of such files by accessing their Internet configuration menu. It is understood that this will prevent the Customer from proceeding with online purchases.

These General Terms and Conditions of Sale are constituted by the entirety of the clauses that compose them. If one or more provisions of these General Terms and Conditions of Sale are considered invalid or declared as such under the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

These General Terms and Conditions of Sale are subject to Italian law. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded, unless there is an international and mandatory consumer protection right.
